St. Louis Attorney Experienced in All Types of Personal Injury Cases

How to Know If You Have a Personal Injury Case

Every year, thousands of people in the St. Louis area suffer personal injuries.

If the negligence, misconduct, or recklessness of someone else directly or indirectly contributed to your injury, you may have a personal injury case.

Under Missouri law, personal injury cases are built on four elements:

  • Duty: Someone had a legal obligation to act with reasonable care to prevent people from injury.
  • Breach: They failed to meet that duty.
  • Causation: That breach of duty contributed to an injury.
  • Damages: That injury caused provable physical, financial, or emotional harm.

You Need a Personal Injury Attorney to Fight for You in Missouri Courts. Here’s Why:

YOUR OPPONENTS WILL BLAME YOU The defendant’s strategy will almost always be to shift blame for your injury onto you. Every bit of liability they pin on you reduces the damages you could win.

Fernandez Law conducts its own investigation and builds a solid case protecting your rights.

YOU’RE OUTMATCHED Insurance companies are large, sophisticated organizations. They have teams of lawyers and investigators with one goal: to pay you as little as possible.

You need an experienced personal injury lawyer who knows how to go head-to-head with Goliaths and win.

MISSOURI COURTS ARE COMPLEX The law is designed to confuse and frustrate people representing themselves.

Litigation involves technical language, obscure arguments, mountains of paperwork, confusing procedures, and inflexible deadlines.

We’ve navigated the ins and outs of the Missouri court system every day for years. When you turn the heavy lifting over to experts, you can focus on recovering and getting back to your daily life.

INSURERS WILL LOW-BALL YOU Insurers are in the business of making money, and that means paying you as little as possible.

They’ll pressure you to accept a settlement that sounds good, before you’ve had time to understand your future needs. Once you settle, you can’t go back for more.

We stand between you and their high-pressure tactics. We use our experience, investigation, and data to calculate what your claim is really worth before you agree to anything.

YOU DESERVE TO RECOVER IN PEACE You’re already dealing with the physical, emotional, and financial impact of your injury.

High-pressure lawyers and complicated paperwork are stressors you don’t need. Let us focus on your claim so you can focus on recovery.

What Is Your Personal Injury Claim Worth?

Missouri personal injury law is intended to restore what you lost, to the extent possible. There are three kinds of damages you may be awarded:

Financial Damages

An injured person and their loved ones can seek compensation for the financial costs of the injury. For example:

  • Past and future medical bills
  • Cost of rehabilitation, therapy, and ongoing care
  • Wages for caregivers needed to do things the injured person can no longer do for themselves
  • Disability accommodations like wheelchair ramps
  • Property damage
  • Out-of-pocket expenses like mileage to travel to rehab appointments
  • Lost wages during recovery
  • Lost future earning capacity

An experienced personal injury lawyer understands not only what your injury has cost you so far, but how it may impact your future finances.

Non-Economic Damages

A personal injury can cause damages that don’t come with a price tag. These intangible losses are real, disruptive, and deserve compensation. Non-economic damages may include:

  • Pain and suffering
  • Emotional distress
  • Post-traumatic stress disorder, depression, and anxiety
  • Loss of enjoyment of life
  • Disfigurement

Punitive Damages

In some cases, a court may find the party at fault in your injury acted in a particularly reckless manner. In those cases, a judge or jury may award punitive damages to punish the defendant.

How Much Can I Get From My Personal Injury Claim?

There is no average or standard range for personal injury compensation. The amount depends on the facts of your case, including the severity of your injuries, the recklessness of the conduct, and the limits of insurance.

While past results are not a guarantee of future outcomes, Fernandez Law has a solid track record of recovering far more than our clients had hoped for.

Past Outcomes:

  • $15 million for the victim of a truck accident
  • $7 million in a medical negligence claim
  • $3 million for a fall on an icy sidewalk
  • $11 million for a factory workplace accident

In your no-obligation consultation, we’ll listen to your story and give you an honest estimate of what your claim might be worth.

What Happens When You Call Fernandez Law

FREE CONSULTATION

When you reach out to Fernandez Law, you’ll get a free, no-obligation consultation. Our experienced, compassionate team will listen to your story and gather the details of your case.

Then we’ll give you our honest assessment: whether you have a case, how strong it is, an estimate on possible damages, and how long it might take to resolve.

Once we take your case, the high-pressure insurance calls you’ve been getting stop. When an attorney or insurer calls you, tell them any communication has to go through us.

INDEPENDENT INVESTIGATION

We’re not content to read reports and file paperwork. We’ll launch our own investigation into the circumstances surrounding your injury.

We gather evidence, review records, interview witnesses, and consult with experts to build your case.

NEGOTIATION

Based on the data from our investigation, what the injury has cost you so far, and what it’s likely to cost you in the future, we calculate a demand for damages.

We put forth our demand and negotiate with the defendant to get you a fair settlement.

TRIAL PREPARATION

Most personal injury cases in St. Louis settle out of court. But we build every case as though it is going to trial.

Insurers know we’re not afraid to take a claim to trial. They don’t bother starting with low-ball offers when we’re on the case.

RESOLUTION AND RECOVERY

Once the case ends, we handle all the paperwork, disbursements, and logistics to get your award into your hands.

Fernandez Law works on a contingency fee basis. Our fee is based on a percentage of your award, with no fees or up-front costs. That means if we don’t win, you don’t pay.

Frequently Asked Questions About Personal Injury Law

How long do I have to file a personal injury lawsuit in Missouri?

In most personal injury cases, you have 5 years from the date of the injury to file suit in Missouri. Across the state line in Illinois, you have 2 years.

There are some exceptions:

  • If the injury isn’t immediately apparent, the 5-year clock starts on the date the injury is discovered.
  • People injured as minors typically have 5 years or until their 21st birthday, whichever is later, to file a claim.
  • Claims against government entities, such as the City of St. Louis or Metro Transit, have dramatically shorter time frames — some as little as 90 days.
  • In a wrongful death suit, the family of the deceased has 3 years from the date of death to file a claim.

In all cases, the sooner you start your claim, the better. As time passes, evidence becomes lost or destroyed, witnesses move away, and memories fade. Meanwhile, the costs of your injury keep compounding.

Can I still sue if my injury is partly my fault?

Yes. Missouri is a comparative fault state. If you were partly at fault for your injury, the amount of damages you’re awarded is reduced by the amount of your liability.

For example, if the court finds you were 25% responsible in a $100,000 claim, you may still recover $75,000.

Insurance companies will paint a picture that puts you at fault to lower the amount they have to pay. An experienced lawyer will get you the level of compensation you really deserve.

How much does a personal injury lawyer cost in St. Louis?

Fernandez Law handles personal injury cases on a contingency fee basis. That means there are no fees or upfront costs when we’re hired.

Our fee is calculated as a percentage of the compensation you win. So if we don’t win your case, you don’t pay.

How do I know if I have a personal injury case?

You likely have a case if:

  • You suffered a real, provable injury, whether physical, psychological, or financial;
  • The injury happened because someone else was negligent or reckless;
  • And you have measurable damages such as pain, lost wages, and medical bills.

The best way to know if you have a case is to consult with an attorney. The initial consultation is free, confidential, and no obligation.

Do I need to hire a personal injury attorney?

Under Missouri law, you are not required to hire an attorney. You can file a personal injury claim yourself.

But people who hire an attorney recover far more money than those who handle claims on their own, even after paying legal fees.

Filing a claim and seeing it through involves complex paperwork, court procedures, and deadlines. You’ll be up against legal professionals who know more than you do about the system and whose job is to make sure you get as little as possible.

How long does a personal injury case take?

Most personal injury cases settle in anywhere from a few months to a year. Cases that go to trial may take two years or more.

In most cases, you should not accept a settlement until your medical team can confidently predict your long-term outcomes. Settling too soon may mean running out of money for future medical needs.

What should I do if an insurance company contacts me about my injury?

If an insurance representative contacts you, do not give them any recorded statement—even if they’re from your insurance company.

Do not give any statements, answer any questions, accept any offers, or sign any releases without first consulting an attorney.

Once you’ve hired an attorney, you can direct insurers to communicate only with your legal team.

What if the other party doesn’t have enough insurance?

Insurance limits are a real concern, especially in catastrophic injuries, where long-term costs can far exceed the limits of any one policy.

Most large awards come from settling with multiple responsible parties. Fernandez Law works to identify every party that may bear some liability in the injury.

What should I look for in a personal injury lawyer?

Look for these factors when choosing a personal injury attorney to represent you:

  • Experience in personal injury cases, particularly in the kind of injury you suffered
  • A track record of substantial settlements and verdicts
  • Trial experience and willingness to go to trial
  • Peer recognition such as ratings and awards
  • Open communication policies so your questions are always answered and you always know where your case stands
  • Positive client reviews
  • A contingency fee model, so they only get paid when you win
